Please help to calculate tax born by the employer under ITO 2001

Agar us ki sirf salary income hay 2,78,000/= to us ki tax liability 2,085/= hi ho gi,,,,
Tak liability nikalny k bad aap tax adjustment kar k taxpayer ka payable ya refundable tax nikalty han..
Missal k tor par tax liability hay 2,085/=
Ab ap is may say less kar day jo WHT withheld kiya tha employer nay yani 2,085/=

Ye 0 ho jaye ga , taxpayer ko return k sath koi tax nahi jama karwana pary ga,,,

Han agar us k mobile phony a telephone par advance tax deduct howa hay to aap wpb hi less kar sakty han, or agar us nay new car kharidi hay ya, apni car ka excise duty k sath advance income tax jama karwaya hay to aap wo bhi less kar sakty hay,,

Yani agar bilfarz us k mobile phone par 1000 or car par 700 advance tax deduct howa tha to a bap jab isy less karyn gay to aap k aps jawab -1700 aye ga ye app ka refundable tax ho ga.

Yaar actualy I am confused with Section 12(3) kidly ready and then reply as mentioned there.

"where an employer agrees to pay the tax chargeable on an employees's salary, the amount of the employee's income chargeable under the head salary shall be grossed up by the amount of tax payable by the employer".


Please reply my previous question in light of above section being an employer what amount should I deposit in Govt. Treasury if I have agreed with employee the no tax will be deducted from his salary.

Zeshan bhai,,, zarori nahi hay k aap har case may marginal relief layn,,, is case may agar app marginal relief layn gay to aap ki tax liability 6850 ho jaye gi 2085 ki jaga...

sidhi si baat hay k agar employer khud bharna chahta hay income tax employee ka to jo tax liability employee ki banti hay usy pahly us ki salary income may add kary or phir dobara say tax liability nikaly,,,,,
misal k tor bar isi case ko lay layty han is case may tax liability 2085 hay ab employer chahta hay k wo ye liability khud day employee ki jaga,
to pahly wo 2085 add kary ga us ki salary income 278000 may, ab us employee ki salary income 280085 ho jaye gi, or tax liability 2101 ho gi,, ab employer 2101 bhar sakta hay income tax employee ki jaga.

@Laptop, dear i passed my tax 1year before since then i have not been in practice regarding the salary tax so i was a littile confuse about marginal reilief as if it was compusory & now since it is established that this is optional

the income of the person is to be grossed up by & then the rate of tax will be applied on resulting figure i.e (278000/99.25)=280,100 will be treated as taxable income and hence the tax slab will be determined

@laptop, dear baat yehy keh 278000 will be treated as 99.25% cuz 0.75% will be borne by the employer, therefore taxable salary will be the 100% & slab will be determined on 100%

Zeen Bhai,,, yo jo calculation aap kar rahy hayn ye tarikakar ITO ya rule may kahan likha hay section ka hawala day dayn,,,,

jis tariky say may nay calculation ki hay us ka hawala ye hay,,

saf saf likha hay k jo tax ka amount hay wo add ho ga tax able income may,,,, ye 99.25 or .75 k chakar mujhay samajh nahi aaya.

@Laptop, gross up kisay kehtay hain bhaai???? actually jo tax aap employee k behalf p pay ker rahay hain woh bhi employee ki income treat hoti hay u just don't simply add it upto the salary of employee, it is not grossing up, just like tax on prizes etc is calculated

luqman.... main sirf apka initial question perh kay answer day rha hun...

gross salary pay jo tax banta hai usay add kerayngay salary main... suppose apki 1,000 salary income hai aur us per 10 tax banta hai to apki total salary income hujyegi 1010.. ab is per dubara say tax calculate kerayngay aur woh huga 11 rs.....
total salary (including tax borne by employer) 1010
rate (suppose) 10%
tax liability 11
less tax credit( as it is paid by employer) (10)
tax payable/(refundable) 1

*it is supposed that no other income except salary.. and tax rate is not changed on adding tax borne by employer in total salary....

Dear Laptop the given format for Tax Calculation - 2010 is not correct as it works on some previous figures like if u puts 270,000 face sheet calculates tax @0.5% but originally applicable rate is 0.75% as mentioned in date sheet, please comment
